I have to give the Trump Administration credit for slipping it's Muslim-ish Ban 2.0 in behind the much more newsworthy Obamacare Lite announcements on Monday. It's kept coverage of the new ban, and reactions to it, relatively muted, or at least not top-of-page headlining.<\/p>\n

The new Executive Order ….<\/p>\n

… Continues to single out six countries (all of them conveniently Muslim-majority) to block immigration from in the name of protecting Americans from jihadist terror (despite the fact that of Muslim immigrants who have committed terror crimes in the US, none of them were from the countries named).<\/p>\n

… Takes Iraq off<\/i> the list, even though it's the headquarters of ISIS itself (it's even in the name). The US military apparently suggested that it was kind of embarrassing to them and their troops on the ground there (Not that you'll hear the Trump Administration suggest its original inclusion was a mistake.)<\/p>\n

… Tries to finesse around the bits and bobs and individual suggestions of injustice by saying that there will be "a robust waiver" program to (theoretically) allow worthy individuals in (though how that appeal process would work is unclear).<\/p>\n

… Avoids creating too<\/i> much embarrassment about refugees by treating Syrian refugees no differently from refugees from the other forbidden countries (120 day suspension, rather than indefinite bar).<\/p>\n

While the original order remains largely intact, there are enough changes that the judiciary may not be quite as quick to step in. That's not stopping a number of states from filing suit to stop it. And it's not clear that the "waiver" program is going to cut it.<\/p>\n

'"That case-by-case process plainly satisfies any possible due process requirements," the administration argued, when a U.S. citizen, company, or university seeks the entry of someone overseas.'<\/i><\/p>\n

Except that how the system will work is unclear, and the presumption that all the "good" people will be able to be waived through but the "bad" people will be waived off presumes that they could do that right now,<\/i> doesn't it?<\/p>\n
