It seems most likely that the expected appeal will not be for the circuit to reconsider <i>en banc<\/i> but to take it directly to SCOTUS &#8212; which was previously unwilling to deal with the issue when there was so much unanimity among the circuit courts.<\/p>\n<p>It seems highly unlikely that SCOTUS will support the 6th Circuit decision, given their acquiescence to other circuit courts to date, and the many marriages that have taken place because of that.
