The 6th Circuit has ruled, 2-1, against a challenge to marriage discrmination laws within its area, the first circuit to have done so. It seems most likely that the expected appeal will not be for the circuit to reconsider en banc<\/i> but to take it directly to SCOTUS — which was previously unwilling to deal with the issue when there was so much unanimity among the circuit courts.<\/p>\n

It seems highly unlikely that SCOTUS will support the 6th Circuit decision, given their acquiescence to other circuit courts to date, and the many marriages that have taken place because of that. But I also hate to trust in this particular Supreme Court to act in … well, a rational or consistent or helpful fashion. <\/p>\n

While I'm not happy that Michigan will be the state to force this into the Supreme Court, I'm happy that it's finally happening.<\/p><\/blockquote>\n
