{"id":5504,"date":"2004-03-02T13:50:55","date_gmt":"2004-03-02T20:50:55","guid":{"rendered":"http:\/\/hill-kleerup.org\/blog\/wp\/2004\/03\/02\/down-the-interstate.html"},"modified":"2014-11-05T15:22:48","modified_gmt":"2014-11-05T22:22:48","slug":"down_the_inters","status":"publish","type":"post","link":"https:\/\/hill-kleerup.org\/blog\/2004\/03\/02\/down_the_inters.html","title":{"rendered":"Down the interstate"},"content":{"rendered":"<p>While I gather that David Frum is not particularly in favor of gay marriage, I think his points on <a title=\"David Frum's Diary on National Review Online\" href=\"http:\/\/www.nationalreview.com\/frum\/diary022704.asp#026007\">how a state-by-state solution won&#8217;t work<\/a> are very well taken.<\/p>\n<p>Through a series of hypothetical questions, he demonstrates the following thesis.  <i>Americans may live in states, but they conduct their financial and legal lives in a united country bound by interstate institutions.<\/i>  Being married (or &#8220;united&#8221;) in just one state, unrecognized anywhere else, will carry with it tremendous risks for the couple should the venture outside of their state, personally or financially.  As the questions Frum gives show, such an arrangement can only end in a situations that are as tragically unfair as gay couples face today &#8212; and as likely to provoke further law suits regarding the &#8220;full faith&#8221; provisions in the Constitution.<\/p>\n<p>A national resolution to the &#8220;marriage&#8221; question will have to be determined, one way or the other.  We may be able to finesse civil unions to be contractual arrangements of a business-like nature, but to tie into society&#8217;s expectation of what <i>marriage <\/i>should legally and naturally imply will require something on a national, thus Federal, level.<\/p>\n<p><small>(via <a href=\"http:\/\/www.donaldsensing.com\/2004_03_01_archive.html#107817186400739252\">Sensing<\/a>)<\/small><\/p>\n","protected":false},"excerpt":{"rendered":"<p>While I gather that David Frum is not particularly in favor of gay marriage, I think his points on how a state-by-state solution won&#8217;t work are very well taken.
