{"id":6374,"date":"2004-09-14T09:29:25","date_gmt":"2004-09-14T16:29:25","guid":{"rendered":"http:\/\/hill-kleerup.org\/blog\/wp\/2004\/09\/14\/you-have-the-right-to-remain-silent-2.html"},"modified":"2004-09-14T09:29:25","modified_gmt":"2004-09-14T16:29:25","slug":"you_have_the_ri","status":"publish","type":"post","link":"https:\/\/hill-kleerup.org\/blog\/2004\/09\/14\/you_have_the_ri.html","title":{"rendered":"You have the right to remain silent"},"content":{"rendered":"<p>I don&#8217;t know what the labor laws are in Alabama, but I suspect that Lynne Gobbell has little recourse to having been <a href=\"http:\/\/www.decaturdaily.com\/decaturdaily\/news\/040912\/sticker.shtml\" target=\"_blank\">fired for having a Kerry\/Edwards bumper sticker on her car<\/a>.<\/p>\n<p class=\"block\">&#8220;We were going back to work from break, and my manager told me that Phil said to remove the sticker off my car or I was fired,&#8221; she said. &#8220;I told him that Phil couldn&#8217;t tell me who to vote for. He said, &#8216;Go tell him.&#8217; &#8220;<br \/>\nShe went to Gaddis&#8217; office, knocked on the door and entered on his orders. &#8220;Phil and another man who works there were there,&#8221; she said. &#8220;I asked him if he said to remove the sticker and he said, &#8216;Yes, I did.&#8217; I told him he couldn&#8217;t tell me who to vote for. When I told him that, he told me, &#8216;I own this place.&#8217; I told him he still couldn&#8217;t tell me who to vote for.&#8221; <br \/>\nGobbell said Gaddis told her to &#8220;get out of here.&#8221; &#8220;I asked him if I was fired and he told me he was thinking about it,&#8221; she said. &#8220;I said, &#8216;Well, am I fired?&#8217; He hollered and said, &#8216;Get out of here and shut the door.&#8217; &#8220;<br \/>\nShe said her manager was standing in another room and she asked him if that meant for her to go back to work or go home. The manager told her to go back to work, but he came back a few minutes later and said, &#8221; &#8216;I reckon you&#8217;re fired. You could either work for him or John Kerry,&#8217; &#8221; Gobbell said.<\/p>\n<p>Which is just stupid on Gaddis&#8217; part, no matter how much of a Bush partisan he may be.  The question, though, from a technical standpoint, is not whether Gaddis can fire someone for having a particular political opinion (something I&#8217;ve rarely seen covered as a protected status, and assuming that Alabama is an at-will employment state) but whether he can control the appearance of private vehicles in the company parking lot.  That might be more legally defensible on his part, though still ethically dubious.
