{"id":6501,"date":"2004-08-25T07:18:07","date_gmt":"2004-08-25T14:18:07","guid":{"rendered":"http:\/\/hill-kleerup.org\/blog\/wp\/2004\/08\/25\/hate-to-say-i-told-you-so-but.html"},"modified":"2014-11-06T07:44:37","modified_gmt":"2014-11-06T14:44:37","slug":"hate_to_say_i_t","status":"publish","type":"post","link":"https:\/\/hill-kleerup.org\/blog\/2004\/08\/25\/hate_to_say_i_t.html","title":{"rendered":"Hate to say I told you so, but &#8230;"},"content":{"rendered":"<p>More of the dangers of a mixed bag of civil union laws across the US have cropped up, <a href=\"http:\/\/story.news.yahoo.com\/news?tmpl=story2&#038;u=\/ap\/20040825\/ap_on_re_us\/lesbian_custody_battle\" target=\"_blank\">this time in Virginia<\/a>.  In this case, a Lesbian couple that entered into a civil union in Vermont, have a 2-year-old daughter.  The daughter was born in Virginia.  The couple dissolved their union in Vermont last year, and a Vermont court ordered temporary visitation rights for the non-custodial partner.<\/p>\n<p>A Virginia court has now claimed jurisdiction over the matter, asserting that since Virginia doesn&#8217;t recognize Vermont&#8217;s civil union laws (indeed, it has some of the <a href=\"https:\/\/www.hill-kleerup.org\/blog\/2004\/04\/22\/an_illustrating.html\" target=\"_blank\">harshest statutory language against civil unions in the US<\/a>), it gets to make such decisions over a child in its territory.<\/p>\n<p class=\"block\"> The American Civil Liberties Union of Virginia and gay rights advocates said the ruling could set a dangerous precedent.  &#8220;The reason child jurisdiction statutes were enacted was to prevent exactly this scenario ? parents fleeing with children from one jurisdiction to another, because they don&#8217;t like the custody rulings of a state,&#8221; Rebecca Glenberg, a lawyer with ACLU, said in a statement.<br \/>\nPrice said the decision could turn Virginia into &#8220;the Las Vegas of gay divorce.&#8221;<br \/>\n&#8220;If you had a civil union in one jurisdiction and you wanted to be clear and free of the responsibilities under it &#8230; you could just move to Virginia and none of those responsibilities would exist anymore,&#8221; he said.<\/p>\n<p>Which, I suspect, is not exactly what either the people of Virginia <em>or <\/em>Vermont want.<\/p>\n<p>And which is one of the problems with the patchwork of civil union laws &#8212; and laws that explicitly <em>don&#8217;t <\/em>recognize them &#8212; we have in this country right now.
