The former protect the fruits of one&#8217;s labors for a time so as to encourage innovation and creativity.  The latter protects consumers from fraudulent attempts to confuse them as to a product&#8217;s origin, and protects the reputation of the entity the trademark represents.<\/p>\n<p>When misused, though, both concepts are dangerous.  Sometimes to a laughable degree.<\/p>\n<p>So take the case of <a href=\"http:\/\/urinal.net\" target=\"_blank\">Urinal.net<\/a>, a site that lets people post pictures of men&#8217;s urinals from various locations.  Kinda weird, but that describes about 99% of non-commercial Internet sites (including this one) and about 50% of the commercial ones, so who am I to complain?<\/p>\n<p>A year ago, someone posted a picture of a urinal there, identifying it as being at the <a href=\"http:\/\/www.gtaa.com\/Index.aspx?Sid=Node1\/Node1.2&#038;Tpl=1\" target=\"_blank\">Toronto Lester B. Pearson International Airport<\/a>, which is operated by the <a href=\"http:\/\/www.gtaa.com\/\" target=\"_blank\">Greater Toronto Airport Authority<\/a>.  The <a href=\"http:\/\/urinal.net\/pissmoan\/#toronto\" target=\"_blank\">GTAA responded<\/a> that it was unlawful for Urinal.net to <a href=\"http:\/\/www.techdirt.com\/articles\/20031113\/1338207_F.shtml\" target=\"_blank\">mention the <em>airport name<\/em><\/a>.  Urinal.net complied with their request to remove the name (whilst <a href=\"http:\/\/urinal.net\/toronto_airpt\/\" target=\"_blank\">describing the airport using everything <em>but <\/em>its name<\/a>), but noted that the GTAA had made them take the info down &#8212; at which point the GTAA said that using <em>their<\/em> name would lead to legal action, too.<\/p>\n<p>Now another &#8220;outraged&#8221; locale is taking things further.  Not only does the <a href=\"http:\/\/www.marcoresort.com\/\" target=\"_blank\">Marco Beach Ocean Resort<\/a> apparently claim that to refer to them in association with a photo of a urinal from their site is a violation of their trademark &#8212; but said location&#8217;s lawyers claim that the cease-and-desist letter sent to Urinal.net cannot be forwarded or reprinted <a href=\"http:\/\/www.techdirt.com\/articles\/20050105\/0132239_F.shtml\" target=\"_blank\">because it&#8217;s <em>copyrighted.<\/em><\/a><\/p>\n<p>Now, flash back to what those purposes of trademark and copyright were again &#8230;<\/p>\n<p>Urinal.net amusingly explains what they can about the situation <a href=\"http:\/\/www.urinal.net\/unnamed_resort_on_marco_island\/\" target=\"_blank\">here<\/a>.  They could fight the matter, perhaps, but who can afford lawyers (assuming they could actually show the c&#038;d letter to one without getting into copyright trouble) to protect a &#8220;hobby&#8221; site.<\/p>\n<p>Of course, in doing this, the folks at <a href=\"http:\/\/www.marcoresort.com\/\" target=\"_blank\">Marco Beach Ocean Resort<\/a> seem unaware that far more people will look at the picture, and associate their name with it, than ever would have happened had they left well enough alone &#8230;<\/p>\n<p><small>(via <a href=\"http:\/\/www.boingboing.net\/2005\/01\/05\/lawyers_attempt_to_f.html\" target=\"_blank\">BoingBoing<\/a>)<\/small><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Copyright and trademark are, in concept, beautiful things.
