This Land Is Mine (unless I get sued about it)

Clive Bundy doesn't have permission to be grazing his cattle on the federal land around I-15, but if his cows that he is grazing there wander onto the Interstate, it isn't his fault, because the state is responsible for maintaining a fence that would keep the cows (that shouldn't be there) off the roadway.

Also, he could totally sue someone for hitting and killing one of his cows, so there.

I'm sure all his supporters against the tyranny of the BLM will chip in to cover his legal fees.

  1. Granted that the following is Colorado law, not Nevada law, I presume they are similar.

    Ordinarily, cows and their owners are not liable for damages if the cows wander into places they oughtn't because a proper fence is not in place. That would argue that the state is liable here.

    Colorado law, though, notes that if the cows are not being legally pastured (as the article indicates is the case here), then the cow owner is responsible for what the cows do.
