The chances of the Ninth Circuit en banc overturning the panel decision seem pretty slim to me, but this is still a clever (if despicable) move on the Pro-8 supporters:
1. There's always a chance the full circuit will, in fact, overturn the three-judge panel. Really small, but still a finite chance.
2. There's always a chance that the full circuit will rule more expansively than the narrow ruling now in effect, increasing the chances of a SCOTUS overturn.
3. It delays the Awful Horrible Dire Abominable Apocalyptic Day of DOOOOOM in California.
4. It offers more time and opportunity for fundraising.
