Whee!
Dobson says “Judge Vaughn Walker nullified the will of 7 million Californians who voted to pass the state constitutional amendment in November ’08” and that this decision “flew into the face and teeth of a strong moral consensus against it.” 7 million Californians is about one fifth the population that is of voting age. I do not think that 20% qualifies as a “strong moral consensus.” Certainly it does not do so to the extent that it justifies violating the Constitution.
As well, consider that 7 million voted for it, 6.4 million voted against it. Again, hardly a “strong moral consensus.”
Regardless, even if it were 7 million to 1, that would not justify violating the US Constitution (though it might give rise to a move to change it).
