- Commentary: What role for emotion? – An interesting review of the emotional side of the Snyder v Phelps SCOTUS arguments, especially given the recent scorn from the Right during the Kagan / Sotomayor confirmation hearings about how awful “empathy” and “compassion” are for judges. Those two actually come off as less swayed by the emotional tenor of the case than ostensibly “balls and strikes” folks like Roberts, Alito, and Scalia.
