Except that the type of heavy crude / diluted bitumen Exxon was pumping is not considered "oil" under the fund's 1980 guidelines. So Exxon didn't pay in any money for cleaning the stuff that, eventually, spilled.
Oh, and the stuff to be sent through Keystone XL pipeline? It's the same sort of material, and will have the same exemption from being taxed for any potential clean-ups. Sounds like a sweet deal to me!
