- Roberts and Alito Legislating From the Bench – An excellent point. If it were simply a matter of reading the law, a lot of these matters would never get to (or need) SCOTUS. Justices must interpret and use their (so to speak) judgment. That’s what makes them so important. Calling it “legislating from the bench” is facile.
