U.S. Circuit Court of Appeals rules that Prop 8 is unconstitutional
San Francisco, Calif., USATue Feb 7: A three-judge panel of the 9th U.S. Circuit Court of Appeals has issued its long-awaited opinion on whether Proposition 8 violates the civil rights of gay men and lesbians.
Proposition 8 was a 2008 California ballot measure that banned same-sex marriage. In August 2010, a federal judge struck down the ban, which was left in place during the appeals process.

It had to go to the SC eventually. I am glad it's working its way there. Sadly, the Court is more right-leaning now than it has been in years past.
Agreed. Though that's small comfort to those being discriminated against now.
More fodder, of course, for Newt's "The Ninth Circuit should be abolished" bandwagon.
Still, it took 100+ years for legalized racism to be abolished. This one is moving faster.
