Inasmuch as the census is mandated by the Constitution, one would think that it would receive more support than, say, the Federal Reserve.
Obviously portions of this were affected by subsequent amendments, but now I'm curious – are native Americans now subject to Federal tax?
One would think. Article 1, Sec. 2, Clause 3.
"Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons. The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct."
The issue comes up with anything that's asked beyond pure head count (the Enumeration). The Constitution only requires that, but does seem to let Congress handle the Constitution "in such Manner as they shall by Law direct", which would seem to include other questions.
That doesn't stop some folks from refusing to give out any other info for fear that it will be used to decide which cell in the hidden slave labor camps they get sorted into, or something.
