The Xenu.net home page is back up on Google. Turns out it didn’t have any copyrighted material on it, and so was not vulnerable to attack under the DMCA. Not that the Scientologists drew that distinction.

Indeed, since Scientology (and every other significant word regarding that organization, including Dianetics and Hubbard) is apparently trademarked, the original notification from them to Google asked that the home page (the main one folks go to anyway via Google) be taken down for trademark infringement. Yes, that’s right, their argument was that you couldn’t even use the word “Scientology” without their permission.

At any rate, since the DMCA only covers copyrights, not trademarks, Google could put it back up.
