Nobody wants a rush to judge capital cases. However, in the case of two death penalty cases that have been under appeal for five years, the Wyoming Supreme Court shows that the alternative isn’t all that great, either.
The two appeals were submitted to the Court in 10/97 and 12/98. Even though Wyoming law calls on their supreme court to give priority to death penalty cases, no judgment on the appeals has ever been handed down, leaving the two defendents just sitting on death row. Some 925 cases have been decided by the Wyoming Surpremes since the first case was appealed.
Better yet, only two of the five Justices who heard the original cases are still members of the court.
